Last year’s plans to modernize the citizenship policy of the Republic of Serbia generated considerable interest. Despite high-level announcements of this possibility, our team of experts responded to numerous inquiries from customers and partners and underscored the importance of legal implementation of these measures. Therefore, we are pleased to announce that the first draft of a law amending the citizenship regulations of the Republic of Serbia has been published.

A key objective of the legal innovations is to attract and retain highly qualified foreigners with specific skills and knowledge that can be considered key to the development of the local economy. This initiative follows the start of a legal overhaul process that will unify the processes of obtaining residence and work permits into a single procedure, allowing foreign nationals to obtain temporary residence and work permits in Serbia at the same time.

For those interested in obtaining Serbian citizenship, the draft of Articles 14 and 15 will receive the most attention.

The proposed Article 15 of the draft introduces a completely new option – the right for foreigners who have resided in Serbia for at least one year on a temporary residence permit and are employed in the territory of Serbia to apply for citizenship before applying.

Our extensive experience in the field of immigration services also supports the thesis that already in the first phase, namely when applying for the temporary residence permit, state authorities will use all legal and discretionary powers to screen applicants according to state interests in a broader sense.

This raises the control over the legality of the application, the documents submitted, the concentration of life and business interests and the general legitimacy of the application to a much higher level. A zero tolerance for violations of the conditions of the visa-free regime (so-called visa run) is applied. In this context, the refusal to issue a residence permit excludes any possibility of legalization for foreign nationals and constitutes a reason for deportation.

Obtaining Serbian citizenship based on the interests of the Republic of Serbia
Regardless of the requirements established by law, there is also a possibility that a foreigner whose admission to citizenship of the Republic of Serbia is in the interests of the Republic of Serbia can obtain Serbian citizenship. The Government of the Republic of Serbia is responsible for deciding what is in the interests of the Republic of Serbia. As a rule, these are people representing important artists, athletes, scientists, foreign investors or other interests of the Republic of Serbia.

Procedure for acquiring citizenship

The application for acquiring citizenship of the Republic of Serbia is submitted to the Ministry of Interior, through the internal affairs bodies at the place of residence or stay of the applicant, and can also be submitted through the relevant diplomatic or consular representation of the Republic of Serbia.

After examining the fulfillment of the requirements, the Ministry issues a decision on admission to citizenship if it concludes that all the requirements prescribed by law are met.
